Service Provider

The service provider is Mediflo sp. z o.o., with its registered office in Warsaw at ul. Marcina Kasprzaka 29/1801, 01-234 Warsaw, Poland, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0001193874, NIP 5273181776, REGON 542709612, share capital PLN 5,000.00 (fully paid).

Definitions

Terms used in these Terms of Use have the following meaning:

  • Service Provider — Mediflo sp. z o.o., as identified in the previous section.
  • User — any natural person, legal entity, or organizational unit using the Website.
  • Website — the marketing website available at mediflo.ai and its subpages.
  • Services — the electronically supplied services provided by the Service Provider, as described in the "Scope of Services" section.
  • Mediflo Platform — the Service Provider's separate SaaS product, governed by a separate individual customer agreement; the Platform is not subject to these Terms of Use.

Scope of Electronically Supplied Services

Via the Website, the Service Provider supplies the following services electronically within the meaning of the Polish Act on the Provision of Electronic Services:

  • Browsing marketing content available on the Website (product information, case studies, blog posts, comparisons).
  • Interacting with the voice bot demo embedded on the homepage — an interactive conversation with an AI assistant for demonstration purposes.
  • Submitting an inquiry via the contact form to receive a response from the Service Provider, including requests for trial access or a Mediflo Platform subscription offer.

These Terms of Use do NOT cover: Mediflo Platform subscription, free trial access to the Platform, services delivered by the Mediflo Platform under customer contracts, or a newsletter. Access to the Mediflo Platform (including any trial access) is granted individually to customers after contact and on the basis of a separate, individually negotiated agreement.

Technical Requirements

To use the Website properly, you need:

  • A device with an internet connection.
  • A current version of a modern web browser (Chrome, Firefox, Safari, Edge) supporting HTML5, CSS3, JavaScript, and cookies.
  • JavaScript enabled.
  • For the voice bot demo interaction — a working microphone and browser permission to use it.
  • For the contact form — an active email account to receive our response.

Voice Bot Demo

The voice bot demo embedded on the homepage is an interactive demonstration of the Service Provider's technology. The demo uses a third-party speech synthesis and recognition provider — see the relevant sub-processor categories in our Privacy Policy.

Audio exchanged during the demo is processed solely to operate the demo and is not used for training AI models. Participation in the demo is entirely voluntary and you can close the demo at any time.

The demo is an AI system within the meaning of the EU AI Act (Regulation 2024/1689). Users are informed that they are interacting with an AI assistant. The bot does not perform medical diagnosis or triage.

User Obligations

The User undertakes to:

  • Use the Website in accordance with its intended purpose and applicable laws.
  • Provide truthful and up-to-date information in the contact form.
  • Refrain from attempts at unauthorized access, automated submissions (spam, bots), circumventing the cookie consent mechanism, or any other actions that could disrupt the Website.
  • Not infringe the rights of third parties, including intellectual property rights.

Prohibition of Unlawful Content

Pursuant to Article 8(3)(2)(b) of the Polish Act on the Provision of Electronic Services, Users are prohibited from supplying content of an unlawful nature. This applies in particular to content transmitted via the contact form and the voice bot demo.

Formation and Termination of the Service Agreement

The agreement for electronically supplied Services is concluded at the moment a given Service is first used:

  • For content browsing — upon accessing the Website.
  • For the voice bot demo — upon starting the interaction.
  • For the contact form — upon submission.

The agreement terminates, respectively: upon leaving the Website, closing the demo, or upon the Service Provider responding to the inquiry. The User may stop using the Services at any time at no cost. The Service Provider may suspend or terminate Services in case of a breach of these Terms.

Complaint Procedure

Users have the right to submit complaints regarding the provision of the Services:

  • Submission channels: complaints may be submitted by email to [email protected] or in writing to the registered office: ul. Marcina Kasprzaka 29/1801, 01-234 Warsaw, Poland.
  • Complaint contents: the complaint should include the User's contact details, a description of the issue, and the expected resolution.
  • Resolution time: the Service Provider will review the complaint within 14 days of receiving a complete submission.
  • Response format: the response is sent through the same channel used for the complaint, unless the User indicates a different preferred channel.

Liability

The Service Provider provides the Services with due care and strives to keep the Website continuously available. However, the Service Provider does not guarantee uninterrupted or error-free operation of the Website and reserves the right to carry out scheduled technical maintenance.

The Service Provider shall not be liable for indirect damages arising from the use or inability to use the Website, to the extent permitted by applicable law. This limitation does not exclude or limit the Service Provider's liability for intentional damage or any liability arising from mandatory legal provisions.

Intellectual Property

All content published on the Website, including texts, graphics, logos, video materials, voices used in the bot demo, and the graphic layout, are subject to the Service Provider's copyright or used under appropriate licenses. Copying, modification, distribution, or use of the Website's content without the Service Provider's consent is prohibited, except for permitted personal use and the right to quote to the extent allowed by the Polish Act on Copyright and Related Rights.

Personal Data

The rules for processing Users' personal data by the Service Provider, including information about the purposes, legal bases, recipients of the data, retention periods, rights of data subjects, and the cookies used, are set out in the Privacy Policy.

Mediflo Platform Subscription — Separate Agreement

The use of the Mediflo Platform (SaaS subscription, free trial, test access) is not covered by these Terms of Use. The terms of using the Mediflo Platform — including trial access — are established individually with each customer in a separate, negotiated agreement. This agreement covers in particular the scope of services provided, SLA commitments, payment terms, protection of entrusted data, and other provisions specific to the B2B relationship.

Governing Law and Dispute Resolution

These Terms of Use are governed by Polish law. In matters not regulated by these Terms, the provisions of the Polish Civil Code, the Act on the Provision of Electronic Services, the Polish Electronic Communications Act, and other applicable provisions of Polish law shall apply.

Any disputes arising from or in connection with these Terms of Use shall be resolved by the court having jurisdiction in accordance with the provisions of the Polish Code of Civil Procedure.

Precedence of the Polish Version

These Terms of Use were drafted in Polish. In the event of any discrepancy between the Polish-language version and versions in other languages, the Polish version shall prevail.

Changes to the Terms

The Service Provider reserves the right to amend these Terms of Use. Material changes will be announced with at least 14 days' advance notice through publication of the new version on the Website, together with information about the changes made. Continued use of the Website after the changes take effect constitutes acceptance thereof.

Effective Date

These Terms of Use are effective as of 8 April 2026 and supersede any previously applicable version.
